1. Agreement to Terms

By accessing or using ouibu ("the Service"), including our mobile application and website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and ouibu regarding your use of the Service.

2. Description of Service

ouibu is a platform that connects people who are looking for workout partners and fitness companions. The Service allows users to:

  • Create a profile with fitness preferences and activities
  • Discover other users based on location and shared interests
  • Connect and communicate with potential workout partners
  • Access premium features through ouibu Pro subscription

3. Eligibility

To use the Service, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously banned from the Service

4. Account Registration

To access certain features, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. User Conduct

When using the Service, you agree NOT to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Post false, misleading, or deceptive content
  • Upload malicious code, viruses, or harmful content
  • Spam or send unsolicited messages
  • Use the Service for commercial purposes without authorization
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use automated systems (bots, scrapers) to access the Service
  • Engage in any activity that interferes with the Service's operation

6. User Content

You retain ownership of content you post on the Service ("User Content"). By posting User Content, you grant ouibu a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating the Service.

You are solely responsible for your User Content and represent that:

  • You own or have the right to post the content
  • The content does not violate any third-party rights
  • The content complies with these Terms and applicable laws

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

7. ouibu Pro Subscription

ouibu Pro is our premium subscription service offering enhanced features. By subscribing:

  • You agree to pay the applicable subscription fees
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You can cancel your subscription at any time through your account settings or app store
  • Refunds are handled according to the app store's refund policies (Apple App Store, Google Play Store)

8. Safety and Meetups

ouibu facilitates connections between users, but we are not responsible for the conduct of users. When meeting other users in person:

  • Meet in public places, especially for first meetings
  • Inform someone you trust about your plans
  • Trust your instincts and leave if you feel uncomfortable
  • Report any suspicious or inappropriate behavior to us

ouibu does not conduct background checks on users. You are responsible for your own safety and interactions with other users.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by ouibu and are protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Reverse engineer or attempt to extract source code from the Service

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results from using the Service will be accurate or reliable
  • Any defects will be corrected
  • You will find compatible workout partners

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUIBU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of other users
  • Unauthorized access to or alteration of your data
  • Any other matter relating to the Service

12. Indemnification

You agree to indemnify and hold harmless ouibu, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and User Content
  • Provisions that should survive termination will remain in effect

You may delete your account at any time through the app settings.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the country where ouibu is established, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts in the jurisdiction where ouibu is established.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
